What I read in a interview he did years ago on the song, when asked if he was being sympathetic to Gallo or not, he said that the song just looked at Gallo in a different light, that the man had 2 sides to him, but he also noted in the same interview that he didn't write the lyrics to the song and they weren't his words/lyrics. So I agree he did advanced a feeling of Gallo also being an okay guy - when Gallo wasn't, but you are correct that was his choice to do so and nobody elses. Still, the Carter song is different, it was written to help the man out, where I don't think Dylan sang "Joey" to help him out, he was already dead by then and didn't need no helping out.
