Yes Carter had been in jail and was out by the time the movie was made, but it was still very much a live issue at the time it would seem. Seems like it still is because of it's controversial nature
There is good reason why eyewitness identification is treated cautiously. It is notoriously unreliable for lots of reasons, people get it wrong all the time.
The chances of a conviction in the U.K. based solely on one persons eyewitness identification, would be slim. Court proceedings are extremely expensive, it is unlikely if the only evidence was an eyewitness identification/account, that the case would even come to court. In Scotland where the law varies from England and Wales, there has to be corroborating evidence. I would be amazed( no I wouldn't lol) if it was different in the U.S.
In Carters case an eyewitness says it wasn't him he wasn't there, but other evidence places him there and points to it being him. So a question mark has to be immediately raised over the veracity of the eyewitness's identification.
