I understand that they have an agreement with Zak that precluded him from being an official member of the band, although some accounts say that an offer to join was made by Townshend and declined. The main issue being that Zak preferred to remain a free agent with flexibility for involvement in other projects outside The Who as well. For example, he drummed for Oasis for several years (2004-2008 if my memory serves me correctly). So his status is more of a long-term touring member, or member in spirit along the lines of Daryl Jones with the Stones.
The situation with Kenney Jones in The Who seems a bit strange, since he was installed as a bona fide after Keith Moon died, and that was over the objections of Roger Daltrey. Then the band disbanded after a couple of albums / tours and reformed a couple of times for one-off gigs. Eventually, the band re-formed for good but Jones was not invited back into the fold. That seems to be a de-facto firing, for lack of a better description. I'd say that Kenney Jones' style of drumming was perfect for Small Faces / Faces, solid but possibly too understated for a band like The Who. And yes, at this point Zak seems to fit the bill as far as capturing the onstage energy of the original line-up.
