I respect your point of view, but digress absolutely....
There isn't a prosecutor who would press charges on a charge of selling loose cigarettes....
A fine maybe but trial ?? never.
So, no matter how big and strong you want to make the 'criminal' , there were like 5 or 6 cops WITH GUNS... so lets not overlook the fact that choke holds are ILLEGAL in NY, however that cop , knowingly used it, and disregarded his lamentations that he couldn't breathe....
To me, and my very unfriendly police experience ( I grew up in Manhattan on 135th Street btwn Bway and Amsterdam) , I see this as absolute Brutality.....
Why don't the cops go mess with the DOPE dealers that have guns too!>!>>!
