Yeah, if you're not registered with ASCAP, you get nothing. For instance, if you have not published your song, and someone records it, they can actually register it with ASCAP under their own publishing company (or the record company will do it, since they don't want to release something not registered) and then the publishing company will get the royalties, not you, even though you wrote it. This has happened to my husband, who refuses to publish his songs under ASCAP (don't ask).

Weirdly, when I was booking a tour a few years back, a lot of the smaller clubs I contacted in the Pacific Northwest were being muscled out of having live music by ASCAP/BMI reps who were demanding that the bars pay prohibitive fines or fees in CASE a band decided to cover a song. That's weird, isn't it? Like, if you were going to play at some roadhouse in Bellingham, WA that the venue would need to be concerned that you might bust out with some cover of a Steve Earle song or whatever?
