I don't know whether Père Lachaise is publicly or privately run, but I'm pretty sure that had Jim been dug out, the family would have also been asked to remove the grave marker.

I just know what I read, but, perhaps his gravesite there is still being paid for, and if so, then his headstone gets to stay.
