I'm sure it's didn't take too much to get permission to do this in the middle of the night considering the circumstances.

I dunno Keno. France is one badly over-regulated country. You need a permit/license for everything. I don't know whether Père Lachaise is publicly or privately run, but I'm pretty sure that had Jim been dug out, the family would have also been asked to remove the grave marker. It's more of a nuisance than an attraction for the authorities. They get lots of complaints from people whose loved ones are buried nearby and whose graves are constantly vandalized with graffiti. Having the police guard the site constantly is an expensive proposition. And the cemetary doesn't need Jim to attract visitors from all over the world: there are more than enough famous people buried there to make it a must-see for most tourists.
